The Affordable Care Act law survives and employers need to operate accordingly.

The Affordable Care Act law has survived the initial repeal and replace attempts of the new administration.  Health care reform is likely to continue playing a role in the administration’s agenda.  However, for the time being, employers (large and small) need to comply with the reporting requirements outlined under the ACA and required by the IRS.

Small Employers that are self-insured need to report using the 1094/1095 B series forms.

Applicable Large Employers need to report using the 1094/1095C series forms (and include covered individuals on Part III, if self-insured).

Reporting deadlines in 2017, for Tax Year 2016:

  • 1095s postmark to Employees 3/2/2017
  • If mailing to IRS:  1094/1095s postmarked by 2/28/2017
  • If filing electronically to IRS:  1094/1095s submitted by 3/31/2017
